Kritarth Janak Pachchigar, a Washington-based certified immigration attorney, said that the Eagle Act, 2022 has been created to enable skilled Indian workers to get green cards quickly. According to the Eagle Act, US employers are allowed to hire any worker based on merit. Not based on where they were born, thus, the Act seeks to remove the country limitation that currently applies to 7% of Indians. Due to this, this Eagle Act has been created so that skilled Indians can easily get a green card and get a job, they can also get a green card for themselves and their close relatives as well as USA Social Security benefits, education benefits and easy movement in their mother country.
The EAGLE Act proposed to increase the countrywise family base immigrant visa cap from 7% to 15%. As this percentage increases, more skilled Indians can immigrate to the USA. But before the Eagle Act was introduced for implementation, it could not be included in the agenda due to overwhelming opposition from members of the Democratic and Republican parties there. That is, neither party allowed it to be tabled by a majority. Given this, it seems that in the coming days, Indians who have gone on H1B visas will have to struggle to stay and renew their H1B visas.
The waiting period of green card can be increased from 90 days to 458 days
